Terms of Use and Conditions of Sale 

These terms and conditions apply to all purchases and use of services and products provided by PERGOSOL AS via our online store at www.pergosol.no. By creating an account or making a purchase on the website, you accept these terms and conditions in their entirety. 

1. General

Buyer: 
The person stated as the buyer in the order. You will be referred to as “you”, “your”, “yours”, etc. 

These terms of sale, together with your order and order confirmation, constitute the contractual basis for the purchase. To shop at PERGOSOL, you must be of legal age or have consent and a payment card from your guardian. 

We only deliver to mainland Norway. All prices are quoted in Norwegian kroner (NOK) and include value added tax (VAT). 

Consumer purchases are regulated by, among other things, the Consumer Purchases Act, the Right of Withdrawal Act and the E-Commerce Act. The legal texts are available at https://lovdata.no. 

2. Order and agreement 

Your order is binding when it is registered with us. You will receive an order confirmation by email. PERGOSOL is also bound if the order is in accordance with our offer in the online store. 

If items are out of stock, you will be notified, and we can offer alternatives or cancel the order in whole/partly. 

3. Prices 

All prices are inclusive of VAT and are quoted in NOK. The total cost is displayed before the order is confirmed, and includes shipping, packaging and any other fees. 

4. Payment 

You can pay by bank or credit card. The purchase price is reserved when ordering and deducted when the goods are shipped. 

Failure to pay may result in debt collection after prior notice. 

5. Delivery 

Estimated delivery time is shown on the product page. When ordering multiple products, the longest delivery time applies. 

Delays will be communicated as soon as we become aware of them. In the event of a significant delay, you can cancel your purchase and receive a refund within 14 days. 

You are responsible for checking the delivery upon receipt. Report any damage or defects as soon as possible. Keep the packaging until the matter has been processed. 

6. Right of withdrawal 

You have 14 days to cancel your order from the date you receive the item. Please notify us by email to info@pergosol.no or in “My Page”. 

The right of withdrawal does not apply to specially ordered or customized goods. 

In the event of a full return, you will receive a full refund including shipping. You will be responsible for the return shipping. The item must be returned in approximately the same condition and quantity as when you received it. Returns must be made within a reasonable time and in the original packaging. 

7. Delay

If we do not deliver at the agreed time and this is not your fault, you can withhold payment, demand delivery, terminate the agreement or claim compensation. 

Claims must be made within a reasonable time. 

8. Complaints and warranty 

You must report any errors/deficiencies within a reasonable time, no later than two months after you discovered the error. 

The warranty period is two years, or five years if the item is intended to last significantly longer. 

Report a complaint in “My page” or in writing to info@pergosol.no. You will be sent a return number and information about the return process. 

If the complaint is approved, PERGOSOL will cover the shipping costs for the return. If the error is repeated (3rd time), you can request a refund. 

9. Card information 

Card data is processed by our payment provider in accordance with security standards (PCI DSS). You can choose to save card information for future purchases. 

10. Privacy 

By using our services, you agree to our processing of personal data in accordance with our Privacy Policy. 

11. Personalization and marketing 

We use cookies and analytics tools to customize content, offers and marketing based on your activities and interests. 

12. Sales pledge 

PERGOSOL reserves the right to a sales lien on delivered goods until the full purchase price has been paid (cf. the Norwegian Pledge Act §3-14). 

13. Customer responsibilities 

As a customer, you are responsible for keeping your contact information up to date and ensuring secure use of your account. You are responsible for the use of your account by others, unless it is due to negligence on the part of PERGOSOL. 

14. Extraordinary circumstances 

PERGOSOL is not responsible for losses due to circumstances beyond our control (force majeure), e.g. natural disasters, war, strikes, pandemics or supplier failure. 

15. Changes to Terms 

PERGOSOL reserves the right to change these terms and conditions. Any changes will be published on the website. 

16. Disputes and choice of law 

Disputes shall be resolved amicably in accordance with Norwegian law. If this is unsuccessful, the matter may be brought before the Norwegian Consumer Authority or a court in Oslo.
